Divorce or Annulment
A divorce or an annulment is required in the State of New Jersey for the dissolution of a marriage regardless of the duration of the marriage or the length of the separation period. Due to recent legislation, New Jersey now offers a no fault divorce as well as the traditional grounds for divorce.
During the divorce process, issues regarding the care and custody of the children, i.e., child support, custody and visitation and the distribution of property (real estate and personal property) will be discussed. This process assists the parties in narrowing their differences and achieving a final resolution that is in the best interest of all concerned.
Unfortunately, during periods of such turmoil, instances of domestic violence may occur. An attorney can assist you in obtaining a temporary restraining order as well as a permanent restraining order. In these circumstances provisions can be made for the temporary support of the marital home as well as child support and spousal support. The protections under the New Jersey Domestic Violence Act (Act) are not limited to married couples. All persons having a dating relationship or familial relationship are entitled to protections under the Act.
